Grounds to decline information request

According to the Article 27 of RA Constitution everyone shall have the right to freedom of expression including freedom to search for, receive and impart information and ideas by any means of information regardless of state borders
The procedure of receiving information is regulated by RA Law “On Freedom of Information”. According to it the request can be written or oral.

 

Procedure of Written Inquiry

 

The applicant is not obliged to ground his inquiry.

The answer of the written inquiry is given within the following terms;

  • If the information required by the written inquiry is not publicized, the copy of the information is given to the applicant within 5 days after the application is filed.
  • If the information required by the written inquiry is publicized, the information on the means, place and time framework of that publication is given within 5 days after the application is filed.
  • If additional work is needed to provide the information required, the information is given to the applicant within 30 days after the application is filed about which a written notice is being provided within 5 days after the application submission, highlighting the reasons for delay and the final deadline when the information will be provided.

 

A written inquiry must be signed to include applicant’s name, last name, citizenship, place of residence, work or study (in case of legal entity name, physical address). A written inquiry is registered and processed as defined by the relevant legislation of processing civilians’ applications and appeals, separately from other types of administration.

A written inquiry remains unanswered if,

it is discovered that the information about the identity of the author is false,

it is the second request on the part of the same person within the last 6 months for the same information, with the exception of the case foreseen by law,

If the information holder does not possess the information sought or the disclosure of that information is beyond his power, within 5 days after the written inquiry is filed, he must inform the applicant about it in a written form. If possible, he must point out the information on the place and body, (including archive) that holds the mentioned information.

If the information holder does not possess all the data on the inquired information, he gives the applicant the part of the data he possesses. If possible, he must point out in the written answer the information for the place and body (including archive) that holds that information.

 

 Procedure of Oral Inquiry

 

 In case of oral inquiry the applicant must in advance tell his name and last name. Oral inquiry is given an answer when

  • The disposal of the required information can prevent the danger facing state and public security, public order, public health and morals, others’ rights and freedoms, environment, person’s property.
  • It is important to make sure that the given information holder has the relevant information.
  • It is important to clarify the procedure according to which the information holder processes the written inquiry.

The answer to the oral inquiry is given immediately after listening to the inquiry or within the shortest possible time frame. If the person making the oral inquiry is not telling his name, last name and/or the oral inquiry does not correspond to the conditions defined by law, the information holder can decline the oral inquiry.

 

Grounds and Procedure to Decline the Information Request

 

Information request can be declined if,

 

1. It contains state, official, bank or trade secret.

2. Violates the privacy of person’s personal and family life, including the privacy of emailing, telephone conversations, telegraphic and other communications.

3. Contains data of preliminary investigation not subject to publication.

 4. Reveals data requiring access restriction conditioned by professional activities (medical, notaries and lawyers secret).

 5. Breaches the copyright and/or related rights.

 If the part of the required information contains data the disclosure of which is subject to declination, information on the rest part is provided.

According to the Articles 27 and 27.1 of RA Constitution and the Article 6 of RA Law “On Freedom of Information”, I am asking you to provide me with information on ____________(narrate the necessary information as clearly as possible).

According to the Article 9 of RA Law “On Freedom of Information” the answer to written inquiry is given to the applicant within 5 days after the application is filed, with the exception of cases when additional work is needed to provide the information required (within 30 days).
Thus, I am asking to answer my information request in the order and time frames defined by law. 

In case the information request is declined, I am asking you to inform me in written form about the grounds of declination (Article 11) and in case of possibility also point out in the written answer the information on the place and body that holds that information and whom I can address to get the information.

(I am ready to pay the expenses of the copies of the information).
