Apparent Abuses in “National Center for Fight against Tuberculosis” SNCO; Charge Pressed against Three Persons (video)

Investigation is conducted in Abovyan Investigative Division of Kotayk Regional Investigative Department of the RA Investigative Committee to find out circumstances of abuses found in “National Center for Fight against Tuberculosis” SNCO. Charge was pressed against three persons.

On July 23, 2018 the materials prepared on the base of the writ addressed to the Police Chief by RA Minister of Health Arsen Torosyan on a number of abuses committed by former employees of SNCO found in the result of audit examination in “National Center for Fight against Tuberculosis” SNCO were received from General Department of Fight against Organized Crime of the RA Police in Kotayk Division.

On August 2, 2018 a criminal case was initiated in RA Police Division of Kotayk according to the Point 1 of the Part 3 of the Article 179 and the Part 1 of the Article 308 of RA Criminal Code preliminary investigation of which is conducted in Abovyan Investigative Division of Kotayk Regional Investigative Department of the RA Investigative Committee.

In the result of investigatory and other procedural actions conducted within the criminal case numerous abuses were found, the persons having committed the apparent financial abuses were identified, the period the abuses were committed and the mechanism were found out.

Through investigation it was found out that the mentioned abuses had been committed from 2014 to 2018.

Investigatory actions of great volume were conducted, documents were confiscated from relevant bodies, searches and interrogations were conducted.

Thus, the SNCO director who has held the position since 2014, having organizational and administrative authorities, out of personal and group interests, with the help of deputy director of SNCO in order to help the social, environmental NGO abused his position against the interests of the service which allegedly caused significant damage to SNCO.  

Particularly, violating the Point 11 of the standard envisaged by the appendix 1 of the order N 59-Ն on confirming «Standard of Fight against Tuberculosis within Free Medical Aid and Service Guaranteed by the State» of the RA Minister of Health dated October 14, 2013 according to which anti tuberculosis treatment through home visits is implemented by the nurses of the cabinet of fight against tuberculosis by direct control on taking medicine, as well as RA Law “On Purchases”, he created assessment commissions for holding a tender to implement state purchase of service provision of “Organizing Home Visits for Treatment of Tuberculosis Patients in 10 RA Provinces and Yerevan” for the purposes of the SNCO for its needs in 2015 and 2016 when it was not necessary.   

The SNCO director instructed a part of the commission members to sign the documents submitted by the employees of purchase division otherwise threatening to dismiss them from work. By his instruction the mentioned documents were not shown to the other part of commission members.

 

As a result, on the base of the decisions made at commission sessions the texts of purchase declarations and invitations which did not contain quantitative indicators for services, exact price for one-point service, any study grounding the service price and the winner in the tender were confirmed and the above mentioned NGO which had not license for “medical aid and service” was found.   

Pursuant to preliminary investigation data, on the base of competition results in 2015 and 2016 state purchase contracts were signed between the NGO and the Center the subject of which was medical aid provision to tuberculosis patients at home by the employees of NGO. On the base of the contract on service provision signed in 2015 43.950.000 AMD was transferred to NGO and the total cost of the contract on service provision signed in 2016 was 67.000.000 AMD. As a result, pecuniary damage of 110.950.000 AMD in total was caused to legal interests of SNCO.

In the framework of the contract the NGO representatives carried out 13.748 visits to tuberculosis patients. The average price of one visit was 4.912 AMD whereas one visit of the mentioned service that is provided by the medical staff of polyclinics costs 1.200 AMD.

Besides, the director abused again his official position to help the same NGO within the contracts on state purchase of service provision of “Organizing Home Visits for Treatment of Tuberculosis Patients in 10 RA Provinces and Yerevan”.

Particularly, every month he orally instructed the chief accountant of the SNCO to transfer the money for the visits carried out by nurses of territorial cabinet of fight against tuberculosis from the bank accounts of SNCO. As a result, from 2015 to 2017 3.341.600 AMD in total was transferred to 40 people without any legal base causing the organization pecuniary damage.

It was also found out that the number of visits mentioned in the delivery-acceptance records each month did not correspond to reality, NGO has never been provided with medication by SNCO whereas all the medication necessary for tuberculosis treatment are located in SNCO’s store and are not sold.

Besides, through the criminal case data were also obtained on the allegation that from 2015 to 2017 “National Center for Fight against Tuberculosis” SNCO signed contracts with 3 other NGO-s and 1 SNCO, as well.

Through preliminary investigation it was found out that the procedure of the tenders was carried out with breaches of RA Legislation, the documents necessary to hold and win tender were incomplete and the members of assessment commissions of tenders were the same persons.

Payments to the above mentioned NGO-s for service provision contracts were made by «Global Foundation of Fight against AIDS, Tuberculosis and Malaria» on the grant account provided to RA Ministry of Health which were transferred from the ministry to “National Center for Fight against Tuberculosis” SNCO based on appropriate agreements.

Through preliminary investigation it was found out that the significant part of the budget of the agreement on grant provision signed between the RA Ministry of Health and Global Foundation was given to “National Center for Fight against Tuberculosis” SNCO.

Besides, the Organization Director showing negligent attitude towards his service, implemented his duties improperly; he gave the chief accountant an authority to possess the money available on the bank account of the company, did not properly control the accountant's activity. As a result, from December 1, 2014 to June 1, 2018 she took advantage of the authority given to her and illegally squandered money in particularly large amount 53.481.928 AMD entrusted to her by entering it to her personal accounts.

On the base of the obtained sufficient evidence charge was pressed against SNCO Director according to the Part 1 of the Article 308 (2 counts), the Point 1 of the Part 3 of the Article 179 (2 counts) and the Part 1 of the Article 315 of RA Criminal Code. Detention was chosen as a pretrial measure against him.

Charge was pressed against chief accountant of SNCO according to the Point 1 of the Part 3 of the Article 179 of RA Criminal Code. Signature mot to leave was used as a pretrial measure against her.

Charge was pressed against deputy director according to the Part 1 of the Article 38-308 of RA Criminal Code. Signature not to leave was used as a pretrial measure against him.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to aw.
