Presentation of Guidebook on “Grounds of Using Pretrial Measure, Procedure of Using Pretrial Measure, Detention, Keeping in Custody within Criminal Cases” Held (photos)

Presentation of the guidebook on “Grounds of Using Pretrial Measure, Procedure of Using Pretrial Measure, Detention, Keeping in Custody within Criminal Cases” was held today in the RA Investigative Committee.

The guidebook was drawn up on the initiative and authority of the Chairman of the RA Investigative Committee Hayk Grigoryan. The co-authors of the guidebook are former Prosecutor General of the Republic of Armenia, former representative of Armenia in European Court of Human Rights Gevorg Kostanyan and chief specialist of Department of Legal Provision and Statistics of Administration of the Investigative Committee Anush Gasparyan.

Together with the leaders of the Investigative Committee RA Minister of Justice Artak Zeynalyan, Ombudsman Arman Tatoyan, Chairman of the Chamber of Advocates Ara Zohrabyan, Rector of Academy of Justice Sergey Arakelyan, Chairman of NA Standing Committee on State and Legal Affairs Vladimir Vardanyan, Chairman of NA Standing Committee on Defense and Security Andranik Kocharyan and advocate Arayik Ghazaryan were present at the presentation.

The Chairman of the Investigative Committee Hayk Grigoryan made a speech mentioning that the guidebook had been drawn up on his initiative. «Procedure of arresting a person, using detention as a pretrial measure against a person has always been and is in the focus of the leaders of the Investigative Committee. Positions of European Court of Human Rights, as well as RA courts have been and are discussed and studies are made. I asked the former Prosecutor General of the Republic of Armenia, former representative of Armenia in European Court of Human Rights Gevorg Kostanyan to show support in the procedure of drawing up the mentioned guidebook taking into consideration the circumstance that he has held this position since 2004, has rich experience and has dealt with the mentioned issues and handled them in these years in the RA and European Court of Human Rights», said Hayk Grigoryan.

The co-author of the guidebook Gevorg Kostanyan first thanked the Chairman of the Investigative Committee Hayk Grigoryan for the initiative to draw up the guideline.

«In our opinion, the necessity was due to the fact that the main form of strengthening social justice in the country is proper preservation of guarantees of criminal justice. And it is not secret for everybody that the most important thing in criminal justice is the guarantee of person's freedom and immunity. And that's why we mainly were concentrated just on the guarantee of the right to person's freedom and immunity that is on the issues of regularity of arrest and detention», said Gevorg Kostanyan.

Chief specialist of Department of Legal Provision and Statistics of Administration of the Investigative Committee Anush Gasparyan briefly presented in her speech the content of the guidebook emphasizing that the abstracts of positions of European Court of Human Rights on detention as a pretrial measure in the context of the right to freedom and personal immunity fixed in the Article 5 of European Convention of Human Rights, verdicts made on the Republic of Armenia, as well as the abstracts of the decisions of Criminal Chamber of the Court of Appeals made in 2007 – 2017 were involved in the guidebook which refer to the grounds of using pretrial measures  fixed by the articles 135-138 of RA Criminal Procedure Code, procedure of using pretrial measure, detention and terms of keeping a person in custody.  

During presentation the guests also made speeches emphasizing the necessity of the guidebook. They also thanked the Chairman of the Investigative Committee Hayk Grigoryan for the initiative and efforts made to realize it.
