Information about criminal cases on domestic violence investigated in first half of 2017 in RA Investigative Committee

Criminal cases on domestic violence investigated in the first half of 2017 in the RA proceeding were examined in the RA Investigative Committee.

Thus, pursuant to examinations in the mentioned period 215 criminal cases on domestic violence were investigated in the first half of 2017 in the proceeding of the RA Investigative Committee one of which is in the proceeding of General Military Investigative Department of the RA Investigative Committee.

Most of the criminal cases refer to violence used by husband – battery, besides, cases of murder, sexual harassment against children committed by a family member, willful evasion from supporting child by the parent and other criminal offences were recorded.     

Thus, out of 215 criminal cases

127 referred to battery envisaged by the Article 118 of RA Criminal Code,

24 – to infliction of willful light damage to health envisaged by the Article 117 of RA Criminal Code,

15 – to threat to murder, to inflict heavy damage to one's health or to destroy property envisaged by the Article 137 of RA Criminal Code,

11 – to sexual intercourse or other sexual acts with a person obviously under 16 envisaged by the Article 141 of RA Criminal Code,

6 – to infliction of willful heavy damage to health envisaged by the Article 112 of RA Criminal Code,

6 – to willful evasion from supporting child by the parent envisaged by the Article 173 of RA Criminal Code,

5 – to murder envisaged by the Article 104 of RA Criminal Code,

4 – to infliction of willful medium-gravity damage to health envisaged by the Article 113 of RA Criminal Code, etc..

In the result of examinations it became clear that out of the crimes committed in the family 2 have been committed by mother, 11 – by father, 1 – by step-mother, 2 – by step father, 2 – by brother/sister, 14 – by son/daughter (including adopted), 63 – by husband, 5 – by wife, 4 – by grandson/granddaughter, 6 – by husband's parents, 5 – by daughter-in-law/son-in-law, 1 – by guardian, trustee or guardian parent.

At the stage of preliminary investigation in the framework of the criminal cases 115 persons were involved as a defendant 60 of which were 18-35 years old, 55 – over 35.

In the framework of the criminal cases 161 persons were found the affected party 8 of which were up to 12 years old, 7 – from 12 to 14, 10 – from 14 to 16, 2 – from 16 to 18, 81 – from 18 to 35, 53 – over 35.

43 criminal cases on 46 persons with the bill of indictment were sent to court.

Note; The term “Domestic violence” is used in the context of formulation given in the Point 3 of the order dated November 17, 2014 of the RA IC Chairman pursuant to which the term “domestic violence” is interpreted in the following way; “…physical and psychological violent actions which are committed inside the family or between either former or current spouses or partners, regardless of whether the perpetrator lives or lived in the same apartment with the affected or not”.
