Employment Procedure

The citizen of the Republic of Armenia, who permanently resides in the Republic of Armenia and has a higher education of certified specialist of law, can be employed in RA Investigative Committee.

The requirements to the employees of the Investigative Committee are defined by RA Law “On RA Investigative Committee”.
 

The citizen cannot be employed by the committee if
 

  • He has been found incompetent or having limited competency by a judicial act which has come into effect.
  • He has been deprived of the right to hold any position in the public service by a judicial act which has come into effect.
  • He has been convicted for committing a crime regardless of whether the conviction has been expunged or cancelled, in the order defined by law.
  • He is subject to criminal prosecution.
  • There is a decision on termination of criminal prosecution on non-acquittal base against him.
  •  He does not meet the requirements defined by the part 1 of this article.
     

The age limit for holding a post in the Investigative Committee is 60. After the maximum age is reached the Chairman of the Investigative Committee can extend the term of service for 5 years.

The age limit of the chairman and deputy chairman of the Investigative Committee is 65 which can be extended by RA President for 2 years.


The list of candidates of the employees of the Investigative Committee

The Qualification Commission, operating in RA Investigative Committee, supplements the candidates of the employees of the Investigative Committee once a year - in January each year, as a rule.

By the instruction of the Chairman of the Investigative Committee additional qualification testing of candidates can be held during the year in order to make supplements in the list of candidates of the employees of the Investigative Committee.

In order to supplement the list of candidates of the employees of the Investigative Committee, at least a month before the application for admission the Qualification Commission publishes an announcement on qualification testing in  press with at least 3000 copies, in the official website of public notices (www.azdarar.am) , as well as in the official website of the Investigative Committee mentioning the application deadlines, place, the day of written examination, as well as the number of places subject to be supplemented.

The person aspiring to be involved in the list of candidates of the employees of the Investigative Committee submits the appropriate documents within the specified term. If the requirements defined by law are not met the admission of applications is rejected and the applications are returned within 3 working days by the Qualification Commission.

The Qualification Commission checks the professional competence, practical skills of the applicant, as well as the compliance of the documents submitted by him with the requirements defined by law.

The applicants having received a positive conclusion by the Qualification Commission are involved in the list of candidates of employees of the Investigative Committee.

The persons involved in the list of the candidates of the employees of the Investigative Committee do a training course in the Academy of Justice and take a qualification examination. The person who has not passed the qualification examination is removed from the list of the candidates of the employees by the decision of the Qualification Commission.

The person is exempted from trainings and qualification examination if he has a professional work experience of a prosecutor, a judge, an investigator or a lawyer if it has not been 5 years since he quitted the job, if the person is a Doctor of Law, or a Candidate of Law who has 5 years’ experience in law.

Through the motion of the person exempted from the training course in the Academy of Justice the Qualification Commission can consider the issue of involving the applicant in the list of the candidates of the employees of the Investigative Committee and the list of official promotion at the same time.

The decisions made by the Qualification Commission can be appealed in the administrative court within 10 working days after receiving the decision. The court examines the case and gives a solution to it within 15 working days after receiving it.

Appealing the rejection of the application admission by the Qualification Commission does not mean to suspend the procedure of application admission, as well as making the list of candidates of the employees of the Investigative Committee, defined by law. In case the court finds the rejection of the application admission unlawful, the application of the applicant is considered by the Qualification Commission.

The investigators of the general departments of the central office of the Investigative Committee, departments and divisions, departments, divisions and garrison investigative units of General Military Investigative Department, Investigative Department of Yerevan, the investigative divisions of administrative districts of Yerevan, divisions of regional investigative departments of the Investigative Committee are appointed by the Chairman of the Investigative Committee out of persons involved in the list of the candidates of the employees of Investigative Committee who have done a training course in the Academy of Justice and passed the qualification examination or have been exempted from the training in the Academy of Justice, in the order defined by law. If the person is appointed, he is removed from the list of the candidates of the employees of the Investigative Committee by the Chairman of the Investigative Committee.
