Preliminary Investigation of Criminal Case Initiated on Fellow Villager's Murder Completed; Charge Pressed against 29 Year-Old Man

Preliminary investigation of the criminal case initiated on murder was completed in Gegharkunik Regional Investigative Department of the RA Investigative Committee. Charge was pressed against 29 year-old resident of Gegharkunik for 56 year-old man's murder.
Through comprehensive investigation conducted within the criminal case it was grounded that the resident of Gegharkunik province, born in 1962, had sustained bodily injuries incompatible with life on July 8, 2018 during the quarrel after the funeral repast by the residents of the same province who are brothers, born in 1980 and 1989.
Particularly, pursuant to actual data obtained during pretrial proceeding on July 8, 2018 at about 14:15 after the funeral repast a row on domestic matters erupted between the villagers during which the younger brother, being under the influence of alcohol, willfully violating public order, showing obvious disrespect towards those present, scolded for a remark made against him and used violence against the fellow villagers. In response to it those present in the incident hit him, too.
However, the latter could not adapt himself to what had happened and with his brother decided to revenge on one of those who had hit him, born in 1962. For this purpose, on the same day at about 20:30 taking a kitchen knife from the house 29 year-old man together with his brother went to the area adjacent to fellow villager's house and stabbed him four times causing cut-pierced penetrating injuries.
On the same day the man died in hospital of bodily injuries he had sustained.
On the base of the obtained evidence charge was pressed against 29 year-old man according to the Part 1 of the Article 104 and the Part 2 of the Article 258 of RA Criminal Code. Detention was chosen as a pretrial measure against him.
Through investigation data were obtained that the man, born in 1980, suffered from mental illness and is registered in mental health center. According the result of forensic psychiatric examination commissioned within the criminal case he was found insane. According to forensic experts the man had committed the mentioned act under the influence of organic cerebral schizophrenia-like disorder. Thus, a decision was made to use compulsory medical treatment against him and to receive a separate proceeding.
Preliminary investigation was completed and the criminal case with the bill of indictment was sent to court.
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
