Head of Gavar Community Alienated Property in Particularly Large Amount Causing Pecuniary Damage of about 27 Million AMD to Community

Preliminary investigation of the criminal proceeding on swindling property in particularly large amount committed by the head of Gavar community with the help of a group of people was completed in Gegharkunik Regional Investigative Department of the RA Investigative Committee.

In the course of preliminary investigation apparent factual data were obtained on the allegation that the head of Gavar community, with the help of 8 members of the Council of Elders, S.D. and B.B, who are in close relations with him, and D.H., the expert of the company, on November 22, 2007 sold the apartment building owned by the community, worth 29 million 350 thousand AMD, to B.B. for a price significantly lower than the market price, 1 million 644 thousand 500 AMD. As a result, property damage in particularly large amount, 27 million 705 thousand 500 AMD was caused to the state.

Particularly, the head of the community, with the intent to swindle the semi-finished apartment building, owned by the community and entrusted to him, on October 8, 2007 signed a real estate purchase agreement. According to the report made as a result of it, the mentioned building was valued significantly below market value - 1 million 406 thousand AMD, even though the alienation of the property had already been predetermined by another decision of the Council of Elders.

Then the 8 members of the Council of Elders made a decision on alienating the semi-finished apartment building, owned by the community, through an auction based on the appraisal report containing false data provided by the company for the purpose of valuing the aforementioned building and registering it in the community's balance sheet.

S.D., who was in close relations with the head of Gavar community, and B.B., S.D.’s cousin, took part in the auction. B.B. was actually found the winner in the formal auction offering 1 million 644 thousand 500 AMD for the real estate.

As a result, on November 2, 2007 the head of Gavar community made a decision to alienate the apartment building to B.B. and to sign a purchase agreement, as prescribed by law, after which B.B.’s ownership right to the mentioned property was registered.

Public criminal prosecution was initiated against the head of Gavar community according to the Point 3 of the Part 3 of the Article 256 of RA Criminal Code, against 8 members of the Council of Elders according to the Point 3 of the Part 3 of the Article 46-256 of RA Criminal Code, against the expert of the company according to the Part 1 of the Article 457 and the Point 3 of the Part 3 of the Article 46-256 of RA Criminal Code, and against the buyer according to the Point 3 of the Part 3 of the Article 46-256 of RA Criminal Code.

Absence ban was applied as a pretrial measure against them.

The criminal proceeding with the bill of indictment was sent to the prosecutor for approval and referral to court.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
