In the result of comprehensive investigation conducted within the criminal case investigated in the Investigative Division of Erebuni and Nubarashen administrative districts of Yerevan Investigative Department of the RA Investigative Committee on escape attempt from “Nubarashen” penitentiary and destruction of property a number of circumstances significant for the criminal case were found out, data were obtained on exceeding official authorities by the employees of penitentiary – violence used against the prisoner.

On August 14, 2018 at 08:50 a call was received from “Nubarashen” penitentiary informing that one of the prisoners went out of the cell, attacked the guardian with a sharp cutting-piercing item, took the keys limiting the entrance and exit of the first building.

On the same day a criminal case was initiated in the RA IC Investigative Division of Erebuni and Nubarashen administrative districts of Yerevan Investigative Department according to the Part 1 of the Article 185 and the Point 2 of the Part 2 of the Article 34-355 of RA Criminal Code. Necessary investigatory and other procedural actions were conducted to find out all circumstances of the case, the cause why the prisoner had taken such a step.

Pursuant to initial data, the prisoner was kept alone in the cell. During inspection of the scene the cell was completely in a mass; the iron beds fastened to the concrete floor and walls were displaced, shutters and glasses of three-shuttered window were broken, the feeding wicket was torn off and separated.

Pursuant to criminal case data, on August 14, 2018 at about 03:00 the prisoner, being in the cell of the penitentiary, opened the iron door of the cell with an adjusted item and attempted to escape during which he broke the window glasses. Then threatening to use violence dangerous for tlife and health of the penitentiary guard with a piece of glass and an iron bar darted out from the bed willfully destroyed and damaged the property of penitentiary. However, he could not escape under unforeseen circumstances. The escape was prevented by the employees of the penitentiary.

Junior specialist of Security Division of “Nubarashen” penitentiary of the RA Ministry of Justice, the guard of the ground floor of the first building was found the injured party and gave testimony. Forensic medical, forensic merchandising examinations were commissioned, a number of people, including the prisoner’s father were questioned.

In the result of comprehensive investigation conducted through the criminal case data were obtained on violence used against the prisoner in the penitentiary.

Particularly, pursuant to initial data the prisoner was subjected to violence by prisoners as well as by employees of penitentiary during which blackjacks, electric shock device was used.

On the base of the obtained evidence charge was pressed against the prisoner of “Nubarashen” penitentiary according to the Point 2 of the Part 2 of the Article 34-355 of RA Criminal Code.

At the same time, considering that through the mentioned criminal case apparent crime on exceeding official authorities by an employee of “Nubarashen” penitentiary of the RA Ministry of Justice was revealed, a new criminal case was initiated in the Investigative Division of Erebuni and Nubarashen administrative districts according to the Part 1 of the Article 309 of RA Criminal Code. A decision was made to join the mentioned criminal cases in one proceeding.

The criminal case was sent to RA Prosecution Office with a motion to send it according to investigatory subordination.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
