Preliminary investigation of the criminal case initiated on murder attempt committed against Davit Simonyan in 2007 was completed in the Investigative Division of Kentron and Nork Marash administrative districts of Yerevan Investigative Department of the RA Investigative Committee. On the base of the obtained evidence charge was pressed against Hayk Sargsyan.

It was earlier informed that Davit Simonyan with a firearm injury was taken to Clinical Hospital N 3 from the crossroad of Tumanyan-Nalbandyan Streets on April 1, 2007. On the same day citizen A. Ghevondyan turned himself to Central Division of the Police, presented a pistol and told that he had found it at the stairs leading to the basement from the kindergarden adjacent to their house and in the result of negligent handling with weapon fired a shot inflicting bodily injury to his friend D. Simonyan.

On May 28, 2007 a decision was made in Central Division of the Police to terminate the proceeding of the criminal case and not to persecute A. Ghevondyan based on reconciliation of the parties and absence of complaint envisaged by the Points 4 and 5 of the Part 1 of the Article 35 of RA Criminal Procedure Code.

Conditioned with newly appeared circumstances on July 3, 2018 the decision on termination of the proceeding was abolished. A new criminal case was initiated preliminary investigation of which was tasked to the Investigative Division of Kentron and Nork-Marash administrative districts of Yerevan Investigative Department of the RA Investigative Committee. The investigator received the case in his proceeding and took necessary investigatory and other procedural measures to provide the comprehensive, objective and complete investigation of circumstances of the case.

As a result, actual data were obtained on the allegation that Davit Simonyan had been inflicted the bodily injury not by negligence by Artur Ghevondyan but on the mentioned day murder attempt was committed against him, the person having committed the alleged crime was identified.

Particularly, pursuant to investigation data, in fact D. Simonyan had been inflicted bodily injury in the room located in the basement of Hayk Alexander Sargsyan's residence in the center of Yerevan on April 1, 2007 at about 16:00 in the result of the shot fired by the latter.

The shot towards the abdomen of the injured was fired from a pistol of «SIG SAUER» type «P 266» model during the argument over domestic affairs inflicting heavy injury.

In the result of measures taken within the criminal case the pistol of «SIG SAUER» type «P 266» model was found and confiscated.

Based on the obtained evidence charge was pressed against Hayk Grigoryan for murder attempt, illegal procurement and keeping of firearm according to the Part 1 of the Article 34-104 and the Part 1 of the Article 235 of RA Criminal Code. On August 17, 2018 preliminary investigation of the criminal case was completed.

Considering that through criminal case data were obtained on apparent abuse of official authorities by an official within the criminal case investigated formerly a new criminal case was initiated in the RA IC Investigative Division of Kentron and Nork Marash administrative districts of Yerevan Investigative Department according to the Part 1 of the Article 308 of RA Criminal Code. A decision was made to send the criminal case according to investigatory subordination.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
