Indian Citizen Kidnapped due to Failure to Pay Required Amount of Damage Caused as a Result of Car Crash; a Citizen of Armenia and 6 Citizens of India Detained

On August 23, 2024 at 00:30, at 1 Acharyan the police officers of the RA Ministry of Internal Affairs stopped a car of «Mitsubishi» make, in the trunk of which a foreigner was found.

On suspicion of kidnapping a person, illegal keeping of weapon, ammunition, 6 persons, who are citizens of India, in the car of «Mitsubishi» make driven by one of them, as well as an Armenian citizen, 36 year-old resident of Vayots Dzor, who had been called to the mentioned place by them, in a car of «Mercedes» make driven by him, were taken to the police station. Through personal search, a folding knife with a blade length of 9 cm, gas pistol with the inscription "EKOL P 29" with a cartridge case charged with gas bullets, were found at one of the Indian citizens.

With regard to the case on August 23, 2024 a criminal proceeding was initiated in the Investigative Division of Avan and Nor Nork administrative districts of Yerevan Investigative Department of the RA Investigative Committee according to the Point 5 of the Part 2 of the Article 191 and the Part 1 of the Article 334 of RA Criminal Code.

The above-mentioned 7 persons were arrested on the base of reasonable suspicion on the crime committal. The person, who had been found in the trunk, was found the victim.

Taking the specifics of the case into account, the conduction of preliminary investigation was assigned to the investigative group.

Through data obtained in the result of large-scale and urgent procedural and evidentiary actions conducted in the investigative division, it was found out that on August 22, 2024, in his office located in Acharyan Street, Yerevan, 36 year-old resident of Vayoths Dzor demanded that the victim within the case, 32 year-old citizen of India, should pay the amount of the damage caused to him as a result of crashing the car of «Nissan Tida» make, in the same month. However, the victim refused to pay because of the lack of money. After it, 36 year-old man called one of the arrested Indian citizens to his office.

After a short while at about 20:00 the latter arrived at the mentioned place with his 5 countrymen in the car of «Mitsubishi» make, driven by him. 36 year-old RA citizen discussed with them the ways of receiving the money owed to him. During that time the victim’s girlfriend also came to the mentioned address.

During the discussion, with the intent to frighten by threatening to cause bodily damage,  the RA citizen fired into the air; he and the other 6 persons demanded that the victim should pay 1.500.000 AMD, otherwise they threatened to take him to another place, where they would cause him bodily injuries, shoot a video and post it on the internet.

Hearing the response of the victim and his girlfriend about not having money, 36 year-old RA citizen required to kidnap the victim. After it the 6 Indian citizens, in a group, realizing and complementing each other's actions, holding the victim from different parts of his body, put him into the trunk of the above-mentioned car of «Mitsubishi» make against his will, the members of the group got into the same car and drove, thus illegally taking the victim to another place.

After driving a certain distance the car of «Mitsubishi» make was stopped by the employees of the police patrol service of the RA Ministry of Internal Affairs and in the result of the inspection 32 year-old citizen of India was found in the car trunk.

On the base of the obtained data charge was pressed against 36 year-old RA citizen according to the Points 5 and 8 of the Part 2 of the Article 46-191 of RA Criminal Code. Charge was pressed against the mentioned 6 citizens of India according to the Points 5 and 8 of the Part 2 of the Article 191 of RA Criminal Code.

Motions were submitted to court to use detention as a pretrial measure against the mentioned 7 defendants. The motions were sufficed.

Preliminary investigation is ongoing.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
