Minor subjected to violence in yard; charge pressed

In the framework of the criminal case investigated in Syuniq Regional Investigative Department of the RA Investigative Committee charge was pressed for using violence against the 12 year-old boy.

On June 5, 2017 a report was received informing that in one of the yards of Kapan town a child, born in 2005, was subjected to battery during which bodily injuries were inflicted to him.

A criminal case was initiated according to the Article 117 of RA Criminal Code preliminary investigation of which is conducted in the RA IC Syuniq Regional Investigative Department.

In the result of necessary investigatory actions conducted through preliminary investigation actual data were obtained on the allegation that bodily injuries were inflicted to the minor during the argument that took place on June 5, 2017 at about 17:30 by a 18 year-old young man. The row erupted over domestic matters during which the 18 year-old young man  used violence against the boy under 16; he pressed his neck with a hand, hit different parts of his body – on the head, the area of the chest inflicting bodily injuries.

Considering the legal position envisaged by the RA Constitutional Court’s decision ՍԴՈ-1333 dated December 20, 2016 pursuant to which “…reconciliation of children under 14 with the suspect, the defendant cannot be a base for termination of the proceeding and criminal prosecution which is a guarantee for judicial protection of rights and interests of this vulnerable category of persons”, on the base of the sufficient evidence obtained through preliminary investigation charge was pressed against 18 year-old young man according to the Article 117 of RA Criminal Code. Signature not to leave was used as a pretrial measure against him.

Preliminary investigation is ongoing, all measures are taken to provide the best interest of the child.
