Individual Engaged in Construction of Multi-Apartment Buildings Caused Damage of 419 Million AMD to State
Preliminary investigation of the criminal proceeding initiated on cases of tax evasion in particularly large amount and deliberate bankruptcy committed by Zh.Sh., was completed in General Department for Investigation of Particularly Important Cases of the RA Investigative Committee.
In the course of the preliminary investigation it was found out that Zh.Sh. carried out the development of multi-apartment residential buildings at two addresses in Yerevan. However, in order to avoid paying the income tax arising from the sale of apartments and parking spaces, he registered the real estate located at those addresses as shared ownership in the names of individuals who were both related to him and those who were actual purchasers of the apartments.
Then, during the period from 2018 to 2025, Zh.Sh. sold the apartments and parking spaces in the buildings constructed at the mentioned addresses to various individuals and, as a guarantee for the purchase of the real estate, transferred to the buyers the shares of the initial co-owners of the mentioned property.
As a result, Zh.Sh. committed tax evasion in the amount of 419 million 57 thousand 820 AMD, causing pecuniary damage in particularly large amount to the state.
At the same time, with the intent to evade the fulfillment of his obligations, Zh.Sh. concealed the fact that he was selling apartments and parking spaces in the buildings constructed at two addresses in Yerevan and generating profit from them. In doing so, he deliberately created characteristics of insolvency and was declared bankrupt on January 25, 2021, based on a court decision, thereby depriving the creditors of the real opportunity to satisfy their property claims.
Public criminal prosecution was initiated against Zh.Sh. according to the Point 2 of the Part 3 of the Article 290 and the Part 1 of the Article 288 of RA Criminal Code.
The criminal proceeding with the bill of indictment was sent to the prosecutor.
