Charge pressed against biological mother of the child and the person having acknowledged paternity for telling false information to Civil Registry Office

Preliminary investigation of the criminal case initiated on telling false information to Civil Registry Office was completed in Shirak Regional Investigative Department of RA Investigative Committee.
 

On October 10, 2014 a report was received in Kumayri Police station of Gyumri from a resident of Gyumri telling that her daughter, being pregnant and being in a bad material state to keep the child, had reached an agreement with another resident of Shirak region to hand him the child after it is born for 1.000 USD. The child was born on September 18 and according to the agreement, her daughter handed the child to him but he did not pay the money he had promised.
 

Through the materials prepared on the base of the report a criminal case was initiated in Shirak Regional Investigative Department according to the Article 168 of RA Criminal Code. During preliminary investigation the woman declined the report she had submitted.
 

Through preliminary investigation it was found that the 26 year-old resident of Gyumri, being pregnant and not having adequate social and material conditions to look after the child after it is delivered, in May-June, 2014 told the neighbors that she wanted to interrupt pregnancy, otherwise she is going to leave her child in hospital or hand to the orphanage after she gives birth. One of her neighbors, learning about her intention, told about it her sister and her husband who had been married for 20 years and did not have any children. The spouses met the woman who was going to leave her child and her mother and asked them not to interrupt the pregnancy. An agreement was reached according to which the spouses were going to take the newborn baby and keep it like their own child.
 

Before the child was born the spouses looked after the pregnant woman, particularly, the wife provided the pregnant woman with food so as she could give birth to a healthy baby. On September 18, 2014 the woman gave birth to a baby boy. Next day – on September 19, 2014 the birth of the newborn baby was registered in Gyumri Territorial Division of Civil Registry Office where the husband submitted an application on acknowledging paternity. The employee of Gyumri Territorial Division of Civil Registry Office warned the applicants about the criminal liability envisaged by the Article 169.1 of RA Criminal Code. However, the applicants insisted that the father of the baby was the given man and the child received his surname.
 

During preliminary investigation a number of forensic examinations were appointed through which it was grounded that the father of the baby was not that man.
 

On the base of the evidence obtained during pretrial proceeding, criminal prosecution according to the Part 1 of the Article 168 of RA Criminal Code against the child’s biological mother and the person having acknowledged paternity was suspended and a charge was pressed against them according to the Article 169.1 of RA Criminal Code. Signature not to leave was chosen as a pretrial measure.
 

The criminal case with the bill of indictment was sent to the prosecutor supervising the legality of preliminary investigation. The bill of indictment was confirmed and the case was sent to the Court of First Instance of Shirak.
 

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
