In the result of comprehensive and objective investigation conducted in the framework of the criminal case investigated in Yerevan Investigative Department of RA Investigative Committee numerous cases of forwarding the decisions on administrative penalty for breaching traffic rules to insolvent persons were found.

Abuses were found through preliminary investigation of the criminal case on running over the citizen S. Bagheyan and causing his death by negligence by “Toyota” initiated according to the Part 2 of the Article 242 of RA Criminal Code. In the result of investigatory actions conducted to find the circumstances of the accident it was found that 11 protocols were formed on breaches formerly committed by the mentioned car.  According to the owner’s application some of them were forwarded to another person and the penalties were not paid. 

In the result of comprehensive investigation it was found that penalties on breaches committed by more than a dozen of other cars were also forwarded to the same person according to the applications of the car owners.

According to investigation data the given citizen, reaching prior agreement with other persons, submitted false applications to Traffic Service of RA Police to forward the decisions on administrative breaches addressed to the latters to him and did not pay the money envisaged by those decisions, inflicting damage to property of Traffic Service of RA Police. The person, whom the penalties were forwarded to, was previously convicted, was released from prison in October, 2011 and worked in several taxi services. He has not a permanent place of residence.

Based on the mentioned materials obtained through investigation on June 8, 2015 a new criminal case was initiated according to the Point 2 of the Part 2 of the Article 184 of RA Criminal Code (Falsifying documents by a group of persons with prior agreement). Preliminary investigation was tasked to Yerevan Investigative Department of RA Investigative Committee. Through investigation of the criminal case a number of counts were found, as well. Two more persons, who were forwarded the penalties on breaches committed by several dozens of other cars according the owners’ applications, were identified, as well.

In order to find a number of essential circumstances, the accomplices, as well as the volume and frame of crimes committed by them, operative-intelligence, investigatory actions were conducted together with the appropriate subdivisions of the Police. As a result, data were obtained that a number of officials of Traffic Service of the Police were related to the mentioned abuses which were expressed in forwarding the decisions on penalties for administrative breaches to insolvent persons, not recording, summoning the same decisions and not forming the decisions on penalties in a proper way, violating the defined order of consideration of applications, as well as in other ways.

On August 19, 2015 the mentioned criminal case was sent to the Prosecution Office of Yerevan and at the same time it was proposed to consider sending the criminal case to RA Special Investigatory Service.
