Within the criminal case investigated in the Investigative Division of Erebuni and Nubarashen administrative districts of Yerevan Investigative Department of the RA Investigative Committee investigatory and other procedural actions are conducted to find out all circumstances of murder of the resident of Spitak town E. Gyulazyan in a way of presenting it as an accident – death caused by drug overdose recorded on March 8, 2018. Actual data were obtained on the allegation that the murder had been ordered. Two persons were detained.   

On March 8, 2018 the body of the resident of Spitak town E. Gyulazyan, born in 1983, was found on the road from Azatan village to Arevik village of Shirak province. Through forensic examination of the body it was found out that his death had been caused by acute toxicity with a substance in which drug alkaloids of «Methamphetamine» and canabinoid types were found.

Some months after the incident new circumstances related to the mentioned case were found out within other criminal cases.

In the result of urgent numerous investigatory actions and operative-intelligence measures of great volume conducted jointly by the Investigative Division of Erebuni and Nubarashen administrative districts, Prosecution Office of the same administrative districts and the Police Division of Erebuni actual data were obtained on the allegation that the death of the resident of Spitak town had not been caused by drug overdose but he had become a murder victim which was carried out by the order of the former prisoner of «Nubarashen» penitentiary.

Thus, in February, 2019 within the criminal cases initiated on illegal turnover of narcotic drugs it was found out that the penitentiary prisoner, born in 1974, who was charged with kidnapping and his case was at the trial stage at that moment, out of revenge ordered another prisoner kept in his cell, born in 1995, to murder the injured party within the mentioned criminal case, the resident of Spitak town E. Gyulazyan, born in 1983, in a way of injecting a large amount of drugs and imitating an overdose.

After reaching agreement on the fee – 10.000 USD for ordering the latter's murder, the 23 year-old prisoner kept together with the prisoner, born in 1974, from the penitentiary connected with his female acquaintance and received her agreement to commit a murder in the mentioned way for money in appropriate amount.

Then, pursuant to scenario and mechanism worked out in advance to commit the murder, the 23 year-old girl presenting herself as a prostitute, under the pretext of providing relevant services connected E. Gyulazyan and met the latter in one of the hotels in Gyumri town. There she injected him with drugs to imitate as if his death was caused by drug overdose.

In order to conceal the crime they took the unconscious and helpless man to a an uninhabited site where the latter was found on March 8, 2018 at 08:00 and died in the ambulance car on the way to «Gyumri Medical Center» CJSC of acute toxicity with a substance in which drug alkaloids of «Methamphetamine» and canabinoid types were found.

Considering that through preliminary investigation of the criminal case initiated on illegal turnover of drugs a new crime was disclosed that is willful illegal deprivation from life committed by a group of people by order with the purpose to conceal another crime, a new criminal case was initiated according to the Points 1, 8 and 11 of the Part 2 of the Article 104 of RA Criminal Code and was separated as a separated proceeding.  

Besides, it was found out that in the RA IC Akhuryan Investigative Division of Shirak Regional Investigative Department materials were prepared on E. Gyulazyan's death, criminal cases were initiated on illegal turnover of drugs of «Methamphetamine» and «Marijuana» types according to the Part 1 of the Article 266 and the Part 1 of the Article 268 of RA Criminal Code which were later suspended and on March 14, 2018 a decision was made not to conduct criminal prosecution on E. Gyulazyan's death.

On the base of the actual data obtained in the RA IC Investigative Division of Erebuni and Nubarashen administrative districts by the decision of RA Prosecutor General on March 4, 2019 the decision on not conducting criminal prosecution on E. Gyulazyan's death made on March 14, 2018 by the investigator of Akhuryan Investigative Division of Shirak Regional Investigative Department of the RA Investigative Committee was abolished.

On the base of the sufficient evidence charge was pressed against the woman, born in 1995, according to the Point 8 of the Part 2 of the Article 104 of RA Criminal Code, charge was pressed against the man, born in 1995, according to the Point 8 of the Part 2 of the Article 38-104 of RA Criminal Code.

By the decisions of the Court of First Instance of Yerevan dated 05.03.2019 detention was used as a pretrial measure against them.

Search was declared against the person who had ordered the murder – the resident of Gyumri, previously convicted for committing a grave crime, Ruben Artashes Sargsyan, born in 1974, September 5, charged with committing crime envisaged by the Point 8 of the Part 2 of the Article 38-104 of RA Criminal Code.

The relevant subdivision of the Police was tasked to take measures to find and bring him to the investigative body.

Preliminary investigation is ongoing. Measures are taken to provide the comprehensive, complete and objective investigation of circumstances of the case.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
