Preliminary Investigation Initiated on Hooliganism Committed in Court Completed
Preliminary investigation of the part separated from the criminal case initiated on hooliganism committed by a group of people in Avan and Nor Nork residence of the Court of First Instance of Yerevan was completed in the Department of Investigation of Grave Crimes of Yerevan Investigative Department of the RA Investigative Committee. Charge was pressed against two persons.
It was earlier informed that on May 13 at about 14:50 62 year-old man submitted a report to Nor Nork Police Division informing that on the same day in Avan and Nor Nork residence of the Court of First Instance of Yerevan a number of people scolded, pulled and hit him on the face with a water container.
In the result of investigatory actions conducted during preliminary investigation a number of circumstances of the incident were found out, three persons having committed the alleged crime were identified; one of them is a resident of Abovyan town, born in 1988, the others are residents of Yerevan, born in 1990 and 1968.
Pursuant to actual data obtained through investigation, on May 13, 2019 at about 13:30 on the first floor of the administrative building of Avan and Nor Nork residence of the Court of First Instance of Yerevan three persons threatening to use violence, destroying somebody else’s property, willfully roughly violated public order, displayed disrespect towards public.
Thus, the persons having committed the alleged crime being on the first floor of the administrative building of Avan and Nor Nork residence of the Court of First Instance of Yerevan, in order to emphasize the supposed supremacy and privilege of their own selves, not obeying the demands of police officers and court bailiffs to stop their hooligan actions and not to limit human rights, willfully roughly violated public order, showed obvious disrespect towards public which was combined with limiting the rights of a 62 year-old resident of Yerevan involved in the meeting to be in the court building, as well as threatening to use violence against him.
Through preliminary investigation it was found out that with the purpose of seizing and destroying the poster 31 year-old man approached 62 year-old man. In the meantime 29 year-old man threatening to use violence against the latter, demanding to get him out of the court building approached him, seized the poster that was in his hand and destroyed it and 51 year-old man hit 62 year-old man on the right cheek with a bottle causing bodily injury.
As a result, the working process of police officers and court bailiffs carrying out service to provide public order was also breached.
On the base of the obtained sufficient evidence charge was pressed against 29 year-old and 31 year-old men according to the Point 1 of the Part 3 of the Article 258 of RA Criminal Code. Signature not to leave was chosen as a pretrial measure against them.
Preliminary investigation was completed and the criminal case with the bill of indictment was sent to prosecutor supervising the legality of preliminary investigation.
As of the third person involved in the incident – 51 year-old man, preliminary investigation of the part separated on him was completed in September, 2019; charge was pressed against him according to the Part 4 of the Article 258 of RA Criminal Code and the criminal case with the bill of indictment was sent to court.
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
