Preliminary investigation of the criminal case initiated on murder of the resident of Gavar town Hayrapet Hergnyan was completed in Gegharkunik Regional Investigative Department of the RA Investigative Committee. Charge was pressed against another resident of the same town.

On March 4, 2018 at 22:45 a call was received from the resident of Gavar town on missing of her husband H. Hergnyan, born in 1963. In the result of measures taken on the base of the report it was found out that the woman last had a telephone conversation with her husband on the same day at about 15:00 during which the latter told her that he was at the area of the market of Gavar and was going home. However, he did not go home and later his phone number became unavailable.

In the result of investigatory and other procedural actions conducted in the framework of the criminal case initiated in Gegharkunik Regional Investigative Department of the RA Investigative Committee it was found out that Hergnyan had become a victim of murder during the quarrel with his fellow villager on money affairs.

Pursuant to preliminary investigation data, on March 4, 2018 at about 15:30 49 year-old resident of Gavar met H. Hergnyan near the store located in Gavar central square. While talking the latter demanded from 49 year-old man the money he had formerly borrowed from him. Then the residents of Gavar got into 49 year-old man's car of «VAZ 21214» make where a row on money erupted between them which turned into brawl.

According to the obtained evidence, with the purpose of illegally depriving H. Hergnyan from life 49 year-old man hit him strongly with his fist on the left cheek of the face inflicting neck fracture and other injuries which caused the latter's death. With the purpose of concealing the crime traces on the same day at about 23:30 the person having committed the alleged crime took the body in his car to the dump area called «Azat» adjacent to Gavar town. There he dug a hole, poured petrol on the body, burnt and covered it with soil.  

It was also found out that 49 year-old man apparently swindled the money, golden ring and watch which were with the murder victim Hergnyan.

Besides, through search conducted within the criminal case in 49 year-old man's residence a precursor - acetic anhydride of 0,00291 kg  kept in a plastic syringe of 5 ml was found in the pocket of autumn jacket in the basement.

Through comprehensive investigation conducted within the criminal case it was also grounded that 49 year-old man gave a false testimony telling that in March, 2018 the police employees beat him because he had not shown them the real place of H. Hergnyan's body in the dump area of Gavar town. As a result, he sustained bodily injuries a part of which had disappeared in the course of time.

During preparation of materials in the RA Special Investigatory Service it was found out that the crime envisaged by the Point 4 of the Part 2 of the Article 309.1 of RA Criminal Code ascribed to police employees had not been committed. Realizing that the information provided by him was false 49 year-old man accused the police employees with particularly grave crime.

On the base of the obtained sufficient evidence charge was pressed against 49 year-old man according to the Part 1 of the Article 104, the Point 2 of the Part 2 of the Article 177, the Part 4 of the Article 266, the Point 1 of the Part 2 of the Article 333 of RA Criminal Code. Detention was chosen as a pretrial measure against him.

Preliminary investigation was completed and the criminal case with the bill of indictment was sent to court.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
