Preliminary investigation of the criminal case initiated on violation of combat duty rules, violence against the subordinate committed by the platoon commander was completed in General Military Investigative Department of RA Investigative Committee.
 

Through the investigation it was found that the commander of the first platoon of the unit N, senior Lieutenant H. Ghazaryan being in charge of soldiers serving in the combat position located at the protection area of the unit of combat duty, breached the rules of combat duty aimed at providing the security of the Republic of Armenia.
 

Particularly, being authorized to implement supervision over the performance of military duties of the subordinate staff and to prevent breaches, he breached the rules himself.
 

Through the investigation sufficient data were obtained on the allegation that while being on duty he used alcoholic beverage in the evening and gave instructions to the watchers of the mentioned time in the result of which the alertness of military base decreased; the mentioned part of the Armenian border was left without sufficient supervision endangering the life and health of the subordinates.
 

Besides, it was found that being reproached related to the performance of his military duties by the assistant to the senior of the position, soldier D. Saribekyan, the platoon commander argued, committed violent acts against him, then immediately after the interference of soldiers who were present at the row, threatened them firing irregular shots.
 

By the evidence obtained through preliminary investigation it was grounded that during the row the soldier D. Saribekyan also committed violence against the senior Lieutenant – he slapped and hit at his chest with the rifle butt stock.
 

On the base of the evidence obtained during pretrial proceeding the senior Lieutenant H. Ghazaryan was charged according to the Part 1 of the Article 365 and the Point 3 of the Part 3 of the Article 358.1 of RA Criminal Code, the soldier D. Saribekyan was charged according to the Point 2 of the Part 3 of the Article 358 of RA Criminal Code.
 

The criminal case with the bill of indictment was sent to the prosecutor supervising the legality of preliminary investigation.
 

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
