A New Department - General Department of Investigation of Crimes against the State, Fundamentals of the Constitutional Order and Public Security Formed at Central Office of the RA Investigative Committee

Based on the requirements of the RA Criminal Procedure Code which has entered into force since June 1, 2022, as well as programs of measures outlined in judicial reforms and anti-corruption strategies, the functions of the General Investigative Department of the RA National Security Service have passed to the RA Investigative Committee since January 1, 2024.

Due to this, 47 positions of the General Investigative Department of the RA National Security Service, 38 of which autonomous (investigators) and 8 civil servants supporting structural subdivision and technical service, have passed to the RA Investigative Committee.

Pursuant to the appropriate order of the Chairman of the RA Investigative Committee, a new subdivision with a status of general department was formed in the structure of the main professional structural subdivisions of the RA Investigative Committee - «General Department of Investigation of Crimes against the State, Fundamentals of the Constitutional Order and Public Security of the RA Investigative Committee». The mentioned subdivision, which will act directly under the coordination of the Chairman of the RA Investigative Committee, has 4 departments.

Pursuant to another order of the Chairman of the RA Investigative Committee, changes have also been made in the charter of the RA Investigative Committee by which the powers and functions of General Department of Investigation of Crimes against the State, Fundamentals of the Constitutional Order and Public Security of the RA Investigative Committee have been defined.

It was defined that the new subdivision would organize and conduct preliminary investigation within the cases on the crimes envisaged by the articles 151 (direct and public calls for aggression), 152 (international terrorism), 308 -317 (crimes related to terrorism), 320 (creating or leading an armed group not provided for by law), 321 (participation in the armed group not provided for by law), 326-330 (organizing or holding a meeting in violation of the order prescribed by law, as well as public calls for mass disorder, hatred, discrimination, intolerance, using violence, its justification), 349 (violation of international flight rules), 350 (violation of RA airspace usage rules), Chapter 42 (Crimes against the fundamentals of the constitutional order and the security of the state) and 469-471 (illegal crossing of the state border, organization of illegal migration, taking, moving or destroying state boundary markers) of RA Criminal Code, as well as within the criminal proceedings assigned to the subdivision by the Chairman of the Committee.

All the former investigators of the General Investigative Department of the RA National Security Service, who have expressed a wish to continue their service in General Department of Investigation of Crimes against the State, Fundamentals of the Constitutional Order and Public Security of the RA Investigative Committee, maintaining their status, have already been appointed to relevant positions by the relevant orders of the Chairman of the RA Investigative Committee.

The positions that have remained vacant, in the near future will be replenished according to the procedure established for the occupation of autonomous positions of the RA Investigative Committee.

The class ranks have been brought to correspondence with those of the positions of the persons holding autonomous positions at the Investigative Committee.

General Department of Investigation of Crimes against the State, Fundamentals of the Constitutional Order and Public Security of the RA Investigative Committee has been allocated in the administrative building of the RA Investigative Committee located at 48 Mamikonyants, next to the central administrative building of the RA Investigative Committee. Taking this circumstance into consideration, it is necessary to address the possible reports on apparent crimes envisaged by the above-mentioned articles of the RA Criminal Code or applications related to preliminary investigation conducted within these crime cases, other documents at the mentioned address.
