Clarification on criminal cases in relation to Vahan Martirosyan

The fact of border crossing by Vahan Martirosyan, who was an injured party and a defendant in the framework of the criminal case, investigated in the RA investigative bodies, and his wife has become a subject of public discussion for the last two days.

At the same time some mass media have come out with subjective and biased assessments “blaming” the investigative body for not taking measures out of its authorizations.

Taking the public interest into consideration, in response to media queries we clarify that necessary investigatory and procedural actions were taken in the framework of the criminal cases, in relation to Vahan Martirosyan,    investigated in territorial subdivisions of the RA Investigative Committee in order to provide the comprehensive investigation of the committed crime, as well as to prevent the possible escape of the suspect.  

Two criminal cases in relation to V. Martirosyan are investigated in the Investigative Committee. One of them is in the proceeding of the Investigative Division of Erebuni and Nubarashen administrative districts of Yerevan Investigative Department in the framework of which he is involved as an injured party; the other criminal case is in the proceeding of the Investigative Division of Arabkir administrative district in the framework of which he is involved as a defendant.

During the investigation it was found that V. Martirosyan had been registered in “Avan” Mental Health Center of the RA Ministry of Health since March 28, 2005 with a diagnosis of “Hysteria personality disorder” (“Avan” Mental Health Center CJSC, 01-89-5107, 20.08.2015).

Thus, on August 15 a written report was submitted in Police Station of Erebuni informing that V. Martirosyan and his wife had been battered at 22/4, Gajegortsner. According to the results of preliminary investigation, on August 19 a criminal case was initiated in Erebuni Investigative Division according to the Article 118 of RA Criminal Code (battery), decisions were made to find V. Martirosyan and his wife Karine Gasparyan as injured parties.

Necessary investigatory and procedural actions were conducted to provide the comprehensive, objective and complete investigation of the case and through the inquiry body the injured parties were summoned to come on August 21 and 27 to be interrogated, as well as to conduct investigatory actions with them as injured parties. The latters did not appear to be interrogated.

On August 28 the Investigative Division of Arabkir administrative district of Yerevan Investigative Department received materials from the Police Station of the same administrative district on stealing 3820 USD from one of the apartments of the house 64, Baghramyan Street, Yerevan. According to the report of the apartment owner, from August 21 to August 25, 2015 Vahan Martirosyan with his wife and child was hosted in her apartment located at the mentioned address and in the same period he stole money in large amount from the apartment.

On 28.08.2015 a criminal case was initiated in the Investigative Division of Arabkir administrative district pursuant to the Point 2 of the Part 2 of the Article 177 of RA Criminal Code, the apartment owner was found an injured party and was interrogated.

In the framework of the criminal case forensic biological, forensic traceological and forensic handwriting examinations were commissioned; V. Martirosyan’s wife was invited to be interrogated who asked for time to present herself to the investigative body with a lawyer.

On August 31 the investigator instructed the Police Station of Arabkir to take necessary operative-intelligence measures to reveal the committed crime, as well as to exclude the possible crossing of the RA state border by V. Martirosyan and his wife K. Gasparyan.

According to the investigator’s decision to apprehend V. Martirosyan, on September 2, 2015 the latter was apprehended and the investigator chose signature not to leave as a pretrial measure against V. Martirosyan as a suspect. V. Martirosyan refused to give testimony

During preliminary investigation of the observed criminal case V. Martirosyan and K. Gasparyan were properly summoned to be interrogated however they did not appear without any excuse. On 04.09.2015 a decision was made to apprehend them once more.

Besides, decisions were made to conduct search in V. Martirosyan’s house located at 22/4, Gajegortsner, to submit motions to the court to get permission to decipher his mobile phone numbers which were considered and sufficed by the court. Search conduction was tasked to the Police Station of Arabkir, the provision of decipherment was tasked to the appropriate mobile operators.

On the base of the obtained evidence on September 9 a decision was made to involve V. Martirosyan as a defendant and search was declared against him.

Preliminary investigation of the two mentioned criminal cases is ongoing.
