After Replacing Detention by Bail as Pretrial Measure Person with Status of Defendant Committed Banditry and Robbery
Investigation is conducted in the Investigative Division of Avan and Nor Nork administrative districts of Yerevan Investigative Department of the RA Investigative Committee to find out all circumstances of banditry and robbery committed against the employees of pharmacies located in Avan district.
On November 3, 2020 at 23:50 the employee of the pharmacy located in Avan district submitted a report informing that on the same day at about 21:40 an unknown person entered the pharmacy, bought pills, paid the money then pushed her to the ground, obviously stole 268.000 AMD from the cash register and fled.
A criminal case was initiated according to the Point 4 of the Part 2 of the Article 176 (robbery) of RA Criminal Code.
Besides, on December 8, 2020 at 23:30 a call was received from another citizen informing that on the same day at about 22:00 in the pharmacy located in Avan district an unknown person attacked his sister – the employee of the same pharmacy, hit her on the head with a stone, stole 30.000 AMD and fled.
A criminal case was initiated according to the Points 3 and 4 of the Part 2 of the Article 175 (banditry) of RA Criminal Code.
Investigatory and other procedural actions were conducted within the criminal cases, including interrogations, videos captured by the cameras were inspected, investigatory action to present the person for recognition by photo was conducted during which the employees of the pharmacies pointed out the same person in the photo.
A decision was made to combine the mentioned two cases in one proceeding and to conduct joint investigation.
In the result of operative-intelligence measures the person in the photo was identified; he is a resident of Kotayk province, born in 1991. The latter was invited to interrogation, as prescribed by law, but he did not come and on December 10, 2020 a decision was made to apprehend him.
It was also found out that the young man was a defendant within another criminal case investigated in the Court of First Instance of Armavir. Detention used as a pretrial measure against him was replaced by bail in October, 2019.
On the base of the obtained sufficient evidence a decision was made to involve 39 year-old resident of Kotayk as a defendant according to the Points 3 and 4 of the Part 2 of the Article 176 and the Points 3 and 4 of the Part 2 of the Article 175 of RA Criminal Code.
A motion was submitted to court to use detention as a pretrial measure against him. It was sufficed.
The relevant subdivision of the RA Police was tasked to take measures to find and bring him to the investigative body.
Preliminary investigation is ongoing.
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
