Burial places in Gyumri have no numbers, plans and citizens not given cemetery certificates; Motion on recorded offences

In the result of comprehensive investigation conducted in the framework of the criminal case investigated on desecration of dead body or burial place and selling the burial place to another person in Gyumri conditions contributing to them were found. They are as follows; the burial places have no numbers, plans and certificates are not given to citizens. Shirak Regional Investigative Department of the RA Investigative Committee submitted a motion to the town hall of Gyumri to discuss the recorded offences and to take measures to abolish them.

Thus; on August 22, 2017 a citizen of Gyumri visited a family cemetery and found out that another person was buried there and a new cemetery was built instead of the old one.

A criminal case was initiated in Shirak Regional Investigative Department of the RA Investigative Committee according to the Point 1 of the Part 2 of the Article 265 of RA Criminal Code and in the result of investigatory and other procedural actions of great volume a number of circumstances significant for the case were found, the frame of those involved, the actions of each of them were clarified.

Through preliminary investigation actual data were obtained on the allegation that in October, 2016 the area of the family cemetery of Gyumri resident was provided for another citizen’s funeral by “Eternal Memory” CJSC for certain money. Moreover, neither the relatives of previously buried person knew that the area of their family cemetery had been given to another citizen, nor the relatives of the dead woman knew that they had been provided with a burial place of another person.

Sufficient evidence were also obtained that with the purpose of concealing the deception the coffin of the previous deceased had been taken out of the burial place, the workers who had carried out excavation in the cemetery and taken out the coffin were identified.

On the base of the obtained evidence charge was pressed against 5 people.

In the result of comprehensive investigation it was found out that no registration is carried out on burial places provided by the CJSC, neither plans are provided. Certificates on cemetery are not given, either, for since the earthquake of December 7, 1988 the burial places in cemeteries operated by the company have had no numbers and plans.

Only funeral register-books are kept in CJSC in which the certain place, row, plan of the provided burial place are not mentioned.

Whereas, on November 23, 2006 the RA Government made a decision “On Funeral Organization and Operation of Cemeteries and Crematorium” on defining the procedures provided by RA Law and certificate form of cemetery / decision N  1910-Ն/ and on January 22, 2007 it was ratified by the RA President.

Presenting the recorded offences in details Shirak Regional Investigative Department of the RA Investigative Committee mediated to the town hall of Gyumri to instruct the specific employees to conduct registration of burial places in cemeteries provided by the mentioned CJSC of Gyumri, to provide plans and cemetery certificates, to have register-books on them and keep them. Besides, it was offered to consider the issue of liability of the employees who had failed while implementing their work within their competencies defined by the RA Government's decision of November 23, 2006.
