Charged with using violence against pupils at “Boarding facility for Child Care and Protection of Byureghavan” SNCO and financial abuse
Preliminary investigation of the criminal case initiated on abuses found in “Boarding facility for Child Care and Protection of Byureghavan” SNCO was completed in General Department of Investigation of Particularly Important Cases of the RA Investigative Committee. In the result of investigatory actions of great volume cases of squandering, embezzlement in particularly large amount, causing bodily or mental sufferance to a number of minors during the educational process committed by several officials of the facility were found.
According to the evidence obtained during preliminary investigation the financial abuses were recorded from 2004 to 2014, violence against pupils was recorded from 2010 to 2014.
The post of the headmaster of “Boarding School N 4 of Byureghavan” from April 17, 2001, then the post of the headmaster of legal successor of the same school “Boarding facility for Child Care and Protection of Byureghavan” SNCO from October 1, 2007 to May 2, 2014 was held by G. Margaryan.
According to preliminary investigation data, with joint intention to commit embezzlement in particularly large amount from 2004 to 2014 a number of persons had been registered in the SNCO who did not implement actual work. In 2004 two persons were registered and in 2007 the number of them increased to more than twenty. They did not actually go to work, however their data had been involved in journals which were official documents on working attendance thus they were forged and confirmed by the headmaster’s signature.
False documents on calculation of salary were created and money for salaries, annual holidays were withdrawn in the name of the mentioned persons, squandered and embezzled.
Besides, during preliminary investigation sufficient data were obtained on the allegation that from 2010 to 2014 in the mentioned educational facility at different stages of educational process violence was periodically used against “disruptive” minor pupils as the headmaster had defined them causing bodily or mental sufferance to them. The number of the affected children is 14.
On the base of the evidence obtained during pretrial proceeding additional charge was pressed against three persons who had been involved as a defendant in the framework of the criminal case.
The headmaster of SNCO G. Margaryan was charged according to the Point 1 of the Part 3 of the Article 179 of RA Criminal Code – squandering in particularly large amount, the Point 1 of the Part 3 of the Article 179 of RA Criminal Code – embezzlement in particularly large amount, the Part 1 of the Article 314 of RA Criminal Code – committing official forgery and the Points 1 and 3 of the Part 2 of the Article 119 of RA Criminal Code – causing bodily or mental sufferance to two or more minors. Detention was chosen as a pretrial measure against her.
The chief accountant P. Martirosyan and the staff inspector A. Hovsepyan were charged according to the Point 1 of the Part 3 of the Article 179 of RA Criminal Code, the Point 1 of the Part 3 of the Article 38-179 and the Part 1 of the Article 38-314.
The criminal case with the bill of indictment was sent to the prosecutor supervising the legality of preliminary investigation. The bill of indictment was confirmed and the case was sent to court.
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
