Being in Medical Center Convict Illegally Procured Narcotic Drug; Preliminary Investigation of Part Separated from Criminal Case Completed and with Bill of Indictment Sent to Court
Preliminary investigation of the part separated from the criminal case initiated on illegal turnover of narcotic drugs without the purpose of sale committed by the convict, abuse of official authorities committed by the members of guard of the convict was completed.
During preliminary investigation it was found out that on November 9, 2019 the convict was taken to Vagharshapat’s medical center to get medical treatment where he was operated on.
While being in medical center, out of personal interests of not refusing the convict’s request, the guard members did not provide constant control on his behavior, did not rule out his communication with medical staff not directly related to the treatment and other people, allowed him to move freely and go out of the ward, see his friends and take prohibited items.
In the result of willful failure to carry out their service duties by the guard members – absence of constant control in the ward, presence of mobile phone the convict had an opportunity to communicate with other people freely and see them. As a result, the convict illegally procured 16.61 grams of narcotic drug of “Marijuana” type in large amount, illegally kept with him and in the evening of November 11, 2019 took it to penitentiary where it was found through personal search conducted by the employees of the penitentiary and was taken.
On the base of the obtained sufficient evidence charge was pressed against the convict of “Armavir” penitentiary according to the Point 2 of the Part 2 of the Article 268 (illegal turnover of narcotic drugs or psychotropic materials without the purpose of sale) of RA Criminal Code. Preliminary investigation was completed and the criminal case with the bill of indictment was sent to court.
The guard members had been earlier charged under the Part 1 of the Article 308 (abuse of official authority) of RA Criminal Code within the criminal case investigated in the RA Special Investigatory Service preliminary investigation of which was completed on January 20, 2020.
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
