Preliminary investigation of the criminal case initiated on abuse of official authorities was completed in General Department of Investigation of Particularly Important Cases of the RA Investigative Committee.

Pursuant to data obtained through comprehensive, complete and objective investigation, Mher Sedrakyan holding the position of the head of Erebuni community of Yerevan from 1999 to 2008, being authorized to carry out organizational-managerial and administrative functions, abusing his official authorities willfully did not carry out his service duties – he did not use administrative liability for unauthorized construction carried out by his son and brother at 2782,55 square meters area of Vardavar park aiming to include them in the latters’ property fund.

In order to legalize the above-mentioned unauthorized constructions and the land as well as to register property right first for the community then for his son and brother, on May 27, 2004 Mher Sedrakyan turned to the relevant territorial subdivision of the State Committee of the Real Estate Cadastre adjacent to the RA Government at the same time providing them with measurement data on unauthorized constructions.

The plan made on the base of the above-mentioned by the territorial subdivision of the State Committee of the Real Estate Cadastre was submitted to Yerevan City Hall after which by Yerevan Mayor’s decision N1319-Ա dated July 19, 2004 the ownership right of Erebuni municipality towards the unauthorized constructions built at the area of Vardavar park and lake Vardavar was registered.

Then on August 5, 2004 on the base of the application of Erebuni Municipality the above-mentioned real estate was divided into 5 parts and on August 6, 2004 state registration for the rights towards the divided property was carried.

With the support of the members of community Council of Elders the area of 12035.5 square meters in total located in Vardavar park owned by Erebuni community of Yerevan was alienated to Mher Sedrakyan’s son and brother by the latter. As a result, the mentioned area with total surface of 12035.5 square meters was taken out of the community’s own fund which negligently caused grave consequences.

On the base of the obtained sufficient evidence charge was pressed against Mher Sedrakyan according to the Part 2 of the Article 308 (abuse of official authority) of RA Criminal Code. Charge was pressed against 5 members of Council of Elders according to the Part 2 of the Article 38-308 (support to abuse of official authority) of RA Criminal Code.

Preliminary investigation was completed and the criminal case with the motion to confirm the bill of indictment was sent to prosecutor.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
