In the result of necessary measures taken within the criminal case investigated in Yerevan Investigative Department of the RA Investigative Committee damage caused to one of the banks operating in Yerevan was completely restored.

On May 16, 2018 a report was received in Nor Nork Division of the RA police from the bank operating in Yerevan informing that on December 26, 2014 and on January 23, 2015 the bank signed loan agreements with LLC according to which 287.307 USD in total was given to LLC. The movables of the company worth 117 million AMD in total were pledged as commitments insurance. On December 16, 2018 the company was declared bankrupt and the movables pledged in the bank were not found. It was found out that after pledging movables until November-December, 2016 the director of the same company sold the pledged goods without replacing them with equivalent property causing pecuniary damage of 65.200.000 AMD to the bank.

On May 25, 2018 a criminal case was initiated in Nor Nork Division of the RA police according to the Part 2 of the Article 184.1 of RA Criminal Code. On June 1 the criminal case was received in the proceeding of Avan and Nor Nork administrative districts of Yerevan Investigative Department of the RA Investigative Committee.

Within the criminal case the mentioned bank was found the affected party. In the result of necessary investigatory and other procedural actions the circumstances of inflicting pecuniary damage to CJSC by LLC, as well as the real volume of the damage caused were found out. In order to get information about the schedule of agreement payment signed between the LLC and the bank an appropriate inquiry was made and according to its response the LLC director’s obligation towards the bank was completely fulfilled.

Considering that the damage caused to the CJSC was completely restored and the circumstance that the LLC director had asked not to prosecute her – to apply amnesty in accordance with the RA Law «On Declaring Amnesty within Criminal Cases Related to the 2800th Anniversary of Foundation of Erebuni-Yerevan and the 100th Anniversary of Independence Declaration of the First Republic of Armenia» on November 16, 2018 a decision was made not to prosecute the former director of LLC according to the Part 2 of the Article 184.1 and to terminate the proceeding of the criminal case based on compensation of the damage caused according to provisions of RA Criminal Code on exemption from criminal liability.
