Four persons involved as a defendant, two as a suspect in the framework of the criminal case on the incident in “Musa Ler” hotel complex

In the result of investigatory actions conducted in the framework of the criminal case investigated in Armavir Regional Investigative Department of the RA Investigative Committee initiated on murder committed on January 6 in “Musa Ler” hotel complex the frame of the participants is found, actions of each of them are personalized and on the base of the obtained evidence relevant legal assessment are made.

According to the evidence obtained through preliminary investigation, the resident of Ejmiatsin S. Tovmasyan also took part in the hooliganism committed in the mentioned hotel complex which resulted in murder of 22 year-old Aram Karapetyan. According to initial data the latter willfully violated the public order, scolded the employees of the hotel complex V. Khachatryan, S. Khlghatyan, used violence against them, as well as against Armen Khlghatyan and Aram Karapetyan who had been called to the hotel complex by S. Khlghatyan.

On the base of the obtained evidence on January 15 the investigator made a decision to involve S. Tovmasyan as a defendant according to the Point 1 of the Part 3 of the Article 258 of RA Criminal Code (hooliganism committed by a group of persons).

Taking into consideration that during preliminary investigation it was impossible to find his whereabouts and he was hiding from the investigative body, on the same day the investigator submitted a motion to the court to use detention as a pretrial measure against him. The motion was sufficed and search was declared against him.

The implementation of the decision was tasked to the relevant subdivisions of the police. Measures are taken to find Artur Babayan who has been under persecution since January 7 charged with A. Karapetyan’s murder.

According to preliminary investigation data, A. Karapetyan was killed in the result of shots fired by one of the participants of the incident 31 year-old A. Babayan. On January 7 he was involved as a defendant according to the Point 1 of the Part 3 of the Article 258 of RA Criminal Code (hooliganism committed by a group of persons), the Point 10 of the Part 2 of the Article 104 of RA Criminal Code (murder out of hooliganism), the Points 1 and 10 of the Part 2 of the Article 34-104 of RA Criminal Code (murder attempt against two or more persons out of hooliganism) and the Part 1 of the Article 235 of RA Criminal Code (illegal procurement, keeping, carrying of weapon). 

On the base of the evidence obtained through preliminary investigation on January 9 search was declared against another participant of the incident, Kh. Khachikyan, as well according to the Point 1 of the Part 3 of the Article 258 of RA Criminal Code (hooliganism committed by a group of persons). The person under persecution today turned himself to the investigative body and necessary investigatory actions are conducted in his presence to provide the comprehensive, objective and complete investigation of the case.

Another person under persecution A. Paravyan turned himself to the investigative body on January 11. He was charged according to the Part 4 of the Article 258 of RA Criminal Code (hooliganism committed with an item used as a weapon) and detention was chosen as a pretrial measure against him.

On January 14 two more residents of Ejmiatsin town, D. Hasratyan and G. Grigoryan turned themselves to the investigative body. They gave evidence according to which on the day of the incident – on the night of January 5, 2016 at about 23:50 they went to the mentioned hotel complex as they had been called by their friend Artur. While being interrogated as a suspect they told that violence had been used against them in the mentioned hotel complex, as a result they had fractures. Signature not to leave was chosen as a pretrial measure against the suspects D. Hasratyan and G. Grigoryan.

The clothes they were wearing at the moment of the incident were confiscated.

Preliminary investigation is ongoing. Forensic examinations were commissioned to find circumstances significant for the case.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
