A criminal proceeding was initiated in Sevan Investigative Division of Gegharkunik Regional Investigative Department of the RA Investigative Committee on hooliganism and intervention in legal service activity of patrols in Chambarak town.

On May 4, 2023 at about 22:30 the patrols carrying out their service in Street September 21 of Chambarak noticed that the car of “Toyota Rav-4” make had stopped on the crosswalk which moved to another place after warning.

In order to inspect the mentioned car as prescribed by law, the patrols stopped it, demanded that the driver should present the documents and found out that the latter was driving the car without a driver’s license. The passenger of the car intervened in the conversation, as it was found out the latter was the head of Chambarak community and the driver was the driver of Chambarak community hall. The conversation turned into argument during which 20-25 people approached and intervened in the argument. They started pulling and pushing the patrols, scolded and one of them punched one of the patrols on the face and fled.

In the result of taken measures the person who had punched the patrol was identified; he is a resident of the same community, born in 1994.

A criminal proceeding was initiated in Sevan Investigative Division of Gegharkunik Regional Investigative Department of the RA Investigative Committee according to the Point 1 of the Part 2 of the Article 297 and the Part 3 of the Article 452 of RA Criminal Code.

Some hours later those involved in the incident were arrested on the base of reasonable suspicion of using violence against the official and brought to the investigative body.

On the base of the facts obtained in the result of evidentiary and other procedural actions conducted during preliminary investigation a decision was made to initiate a public criminal proceeding against the head and the driver of the community according to the Point 1 of the Part 2 of the Article 297 of RA Criminal Code (hooliganism committed by a group of people) and absence ban was chosen as a pretrial measure against them.

Public criminal prosecution was initiated against 29 year-old resident of Chambarak according to the Point 1 of the Part 2 of the Article 297 and the Part 3 of the Article 452 (intervention in legal service or political activity of an official by using violence) of RA Criminal Code. By the court’s decision, detention was used as a pretrial measure against the latter.

Preliminary investigation is ongoing. Measures are taken to find out all circumstances of the case, to identify those involved in the incident, to give legal assessment to actions of each of them.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
