Preliminary investigation of the criminal case on armed assault committed in Yerevan against Vahagn Abgaryan and four persons accompanying him was completed on two more defendants – A. Karadavidov and A. Blbulyan in General Department of Investigation of Particularly Important Cases of the RA Investigative Committee.  

We remind that on September 14, 2017 shots were fired towards the resident of Lori region Vahagn Abgaryan and four persons with him near the hotel located at 48, Hanrapetutyan Street. As a result, one person - Gagik Mosinyan, born in 1974, died at the scene of the firearm injuries he had sustained, Vahagn Abgaryan, born in 1978, with firearm injuries was taken to medical center.

A criminal case was initiated according to the Point 1 of the Part 2 of the Article 34-104, the Points 6, 7 of the Part 2 of the Article 104 and the Part 1 of the Article 235 of RA Criminal Code preliminary investigation of which was conducted in the RA IC General Department of Investigation of Particularly Important Cases.

In the result of investigatory and other procedural actions of great volume conducted during preliminary investigation a number of circumstances significant for the criminal case, the motive were found out, the persons having committed the alleged crime were identified; they are residents of Alaverdi A. Blbulyan, A. Karadavidov and the resident of Yerevan R. Khachatryan, the actions of each of them were personalized.

Pursuant to data obtained during pretrial proceeding in 2017 R. Khachatryan reached prior agreement with his acquaintances A. Karadavidov and A. Blbulyan on committing murder of the resident of Alaverdi V. Abgaryan and persons accompanying him Gagik Mosinyan, Artur Mnatsakanyan, Aram Khachatryan, Davit Budaghyan out of revenge, the roles were distributed, as well.

Pursuant to investigation data, for this purpose A. Karadavidov and A. Blbulyan illegally procured a rifle of “AKS – 74” model, a pistol of “Baykal 442” model, bullets and illegally kept them in an apartment in Yerevan rented in 2017, they also obtained a car of «Volkswagen Jetta» make on the base of the lease contract signed in Rafik Khachatryan’s name.

In order to carry out the criminal intention, being sure that Vahagn Abgaryan and the person accompanying him arrived in Yerevan on September 13, 2017 and stayed at the hotel located at 48, Hanrapetutyan Street, after examining the area, choosing the most suitable place for murder and parking the car in front of the central entrance of the hotel, Karadavidov and Blbulyan ambushed at the back part of the car and waited for Vahagn Abgaryan and his friends.

On September 14, 2017 at about 13:26 noticing Vahagn Abgaryan, Gagik Mosinyan, Artur Mnatsakanyan, Davit Budaghyan and Aram Khachatryan leaving the hotel, with the purpose of illegal deprivation of their life, they got out of the car and fired numerous shots towards Vahagn Abgaryan and those accompanying him with a rifle and pistol kept illegally by them also endangering the life of the hotel employees, visitors and the people nearby.

In the meantime, in order to support Armen Karadavidov and Albert Blbulyan’s actions, to make a false impression on the number of those who had fired shots and thus to exclude the possible resistance, pursuant to the agreement reached in advance, Rafik Khachatryan pointed the rifle towards Vahagn Abgaryan and those accompanying him lying on the ground but did not fire after which he fled together with the group members.

In the result of shots fired by Armen Karadavidov Gagik Mosinyan was inflicted a heavy firearm injury which caused the latter’s death at the scene. Vahagn Abgaryan was inflicted heavy firearm injuries. However, the criminal intention to illegally deprive Vahagn Abgaryan, Artur Mnatsakanyan, Davit Budaghyan and Aram Khachatryan from life was not carried out under unforeseen circumstances.

On the base of sufficient evidence obtained during pretrial proceeding charge was pressed against Armen Karadavidov according to the Points 6 and 7 of the Part 2 of the Article 104, the Point 1 of the Part 2 of the Article 34-104 and the Part 1 of the Article 235 of RA Criminal Code. Charge was pressed against Albert Blbulyan according to the Points 6 and 7 of the Part 2 of the Article 104, the Point 1 of the Part 2 of the Article 34-104 and the Part 1 of the Article 235 of RA Criminal Code.

Preliminary investigation on the separated part on Armen Karadavidov and Albert Blbulyan was completed and the criminal case with the bill of indictment was sent to court.

Through preliminary investigation of the criminal case the person (persons) who illegally sold the weapon and ammunition, which were the crime tool, is (are) not identified, the circumstances are not found out yet.

Thus, a decision was made to separate the part on illegal sale of the above-mentioned firearms and bullets to Armen Karadavidov and Albert Blbulyan as a separate proceeding preliminary investigation of which is ongoing.

It was earlier informed that charge was pressed against R. Khachatryan according to the Points 6 and 7 of the Part 2 of the Article 38-104, the Point 1 of the Part 2 of the Article 38-34-104 and the Part 1 of the Article 235 of RA Criminal Code. The part on him was separated as a separate proceeding, preliminary investigation was completed and the case with the bill of indictment was sent to court.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
