Information about Investigation Results of Criminal Cases on Domestic Violence Investigated in 2019 in Proceeding of RA Investigative Committee

In 2019 422 materials on domestic violence were prepared by subdivisions of the RA Investigative Committee.

In 2019 635 criminal cases on domestic violence were in the proceeding of the RA Investigative Committee 8 of which in General Military Investigative Department.

In 2019 14 of the above-mentioned 635 criminal cases on domestic violence were initiated according to the Article 104 of RA Criminal Code (murder), 2 – according to the Article 109 of RA Criminal Code (causing death by negligence), 4 – according to the Article 110 of RA Criminal Code (causing to commit suicide), 11 – according to the Article 112 of RA Criminal Code (infliction of willful heavy damage to health), 12 – according to the Article 113 of RA Criminal Code (infliction of willful medium-gravity damage to health),

51 – according to the Article 117 of RA Criminal Code (infliction of willful light damage to health), 338 – according to the Article 118 of RA Criminal Code (battery), 12 – according to the Article 119 of RA Criminal Code (causing strong pain or bodily or mental sufferance), 1 – according to the Article 120 of RA Criminal Code (inflicting grave damage by negligence), 1 – according to the Article 121 of RA Criminal Code (inflicting medium gravity damage by negligence), 2 – according to the Article 131 of RA Criminal Code (kidnapping),

1 – according to the Article 133 of RA Criminal Code (illegal deprivation of freedom), 68 – according to the Article 137 of RA Criminal Code (threat to murder, to inflict heavy damage to one’s health or to destroy property), 1 – according to the Article 138 of RA Criminal Code (rape), 2 – according to the Article 139 of RA Criminal Code (violent sexual actions), 2 – according to the Article 140 of RA Criminal Code (forcing a person to sexual intercourse or other sexual actions), 14 – according to the Article 141 of RA Criminal Code (sexual intercourse or other sexual acts with a person under 16),

3 – according to the Article 142 of RA Criminal Code (lecherous acts), 1 – according to the Article 144 of RA Criminal Code (illegal collecting, keeping, use and dissemination of information pertaining to personal or family life), 6 – according to the Article 167 of RA Criminal Code (illegal separation of the child from the parents or substitution of the child), 13 – according to the Article 167.1 of RA Criminal Code (preventing a parent or other close relative from having a child visit), 2 – according to the Article 169.1 of RA Criminal Code (reporting false information to Civil Status Act Registration Bodies), 3 – according to the Article 170 of RA Criminal Code (failure to fulfill the duty of rearing the child), 

14 – according to the Article 173 of RA Criminal Code (willful evasion from supporting one’s child by the parent), 3 – according to the Article 185 of RA Criminal Code (willful destruction or spoilage of property), 33 – according to the Article 353.1 of RA Criminal Code (willful failure to carry out an effective court sentence) and 21 – according to other articles.  

Within the above-mentioned criminal cases 358 persons were involved as a defendant; 3 of them were from 14 to 18 years old, 129 – from 18 to 35, 226 – over 35.

13 of the crimes committed within families were committed by mother, 29 – by father, 3 – by step father, 14 – by brother/sister, 2 – by grandfather/grandmother, 43 – by son/ daughter (including adopted one), 6 – by wife, 219 – by husband, 5 – by grandchild, 15 – by husband’s parents, 8 – by daughter/son-in law (the sum of the numbers presented is 357 which is conditioned with the circumstance that within 1 criminal case the person has had two status – conditioned with committing the act against several members of the family).

18 of the mentioned persons have previously been convicted.

Within the criminal cases there were 536 affected 39 of which were up to 12 years old, 15 – from 12 to 14 years old, 13 – from 14 to 16, 17 – from 16 to 18, 193 – from 18 to 35, 259 – over 35.

In 2019 468 criminal cases on domestic violence were completed.

Proceeding of 326 criminal cases was terminated 129 of which were on acquittal, 197 – on non-acquittal bases.

128 criminal cases with the bill of indictment were sent to court.

14 motions on using medical coercive measures were submitted to court.

Proceeding of 33 criminal cases was suspended 18 of which based on the circumstance that the person was under persecution, 15 – on other bases.

In 2019 61 criminal cases were joint.

8 criminal cases were sent according to investigatory subordination.

65 criminal cases, in total, together with the cases passed from 2019 are incomplete.
