Providing Civil Registration Agency with False Information Recognized Paternity and Submitted False Act to Court

Through the criminal case investigated in General Department of Investigation of Particularly Important Cases of the RA Investigative Committee a number of circumstances of registering an act of recognition of paternity by providing the Territorial Subdivision of Erebuni and Nubarashen of Civil Registration Agency with apparent false information and then submitting the false act to court committed by the resident of Yerevan A. V. were found out.

Pursuant to data obtained through investigation, on June 18, 2018 A. V. was involved as a defendant according to the Points 1, 2 and 3 of the Part 2 of the Article 131 (kidnapping) of RA Criminal Code within the criminal case investigated in the RA Special Investigatory Service, detention was chosen as a pretrial measure against him and search was declared. On October 4, 2018 A. V. was found and apprehended and the next day detention chosen as a pretrial measure against him was replaced by mortgage. On December 13, 2018 the criminal case on A. V. and his accomplice with the bill of indictment was received in the Court of First Instance of Yerevan.

By the documents submitted to court by A. V. it was confirmed that he had a child of up to 3 years old and based on it an amnesty law was passed. Pursuant to it “those sentenced to maximum of six years' imprisonment having a child of up to 3 years old, as of the date of entry into force of the law, are released from punishment”. On the same day a decision was made to stop the criminal prosecution against A. V. and to terminate the proceeding.

In the result of measures of great volume taken jointly by the RA Investigative Committee and the RA Police, as well as through forensic genetic examinations it was found out that 3 days before passing the amnesty law – on October 29, 2018 the application of parents - the accused A. V. and witness I. D. on recognition of paternity was received in the Territorial Subdivision of Erebuni and Nubarashen of Civil Registration Agency with which the latters, being warned about liability envisaged by the Article 169.1 of RA Criminal Code for providing false information, provided false information that A. V. was allegedly the father of the mentioned child. On the same day the child was given a new birth certificate in which the name child’s father mentioned formerly was changed and A. V. was registered as the child’s father. Then the changed act was submitted to court and the above mentioned judicial act on releasing A. V. from liability was made.

A decision was made to involve A. V. as a defendant according to the Part 1 of the Article 169.1 and the Article 325 of RA Criminal Code and the criminal case was combined to another criminal case investigated in General Department of Investigation of Particularly Important Cases of the RA Investigative Committee within which A. V. has already been involved as a defendant according to the Point 6 of the Part 2 of the Article 38-34-104 (organizing murder attempt), the Part 1 of the Article 38-131 (organizing kidnapping), the Point 1 of the Part 3 of the Article 38-176 (organizing robbery), the Point 2 of the Part 3 of the Article 182 (extortion) of RA Criminal Code. Detention was chosen as a pretrial measure against him.

Preliminary investigation is ongoing.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
