Within Criminal case on murder of 41 Year-Old Resident of Spitak with Particular Cruelty Charge Pressed against Fourth Person for Failure to Report Surely Known Particularly Grave Crime
Preliminary investigation of the part separated from the criminal case initiated on murder committed by a group of people was completed in Lori Regional Investigative Department of the RA Investigative Committee; charge was pressed against a resident of Vanadzor for failure to report particularly grave crime.
In the result of investigatory and other procedural actions conducted during preliminary investigation it was found out that 31 year-old resident of Vanadzor was aware of tense relations between his close friends and the resident of Spitak and heard in the car that they were going to take revenge on the latter and kill him.
Moreover, on January 15, 2019 at about 13:00 he left for the scene together with his friends, witnessed a particularly grave crime committed by them; that is firing shots towards the victim with a firearm procured illegally for the purpose of illegal deprivation of life, in a way dangerous for many people's life, cutting the latter’s left ear as well as the upper edge of the right ear with a knife with particular cruelty that is murdering him and fled together with his friends.
On the base of sufficient evidence obtained during pretrial proceeding charge was pressed against 31 year-old man according to the Part 1 of the Article 335 (failure to report crime) of RA Criminal Code. Preliminary investigation of the mentioned count was also completed.
It was earlier informed that preliminary investigation of the part on three persons separated from the criminal case was completed and the criminal case with the bill of indictment was sent to court.
Charge was pressed against one of them according to the Points 5 and 7 of the Part 2 of the Article 104 (murder), against the second one – according to the Points 6 and 7 of the Part 2 of the Article 104, the Part 1 of the Article 113 (willful infliction of damage of medium gravity) and the Part 1 of the Article 235 (illegal procurement, transportation or carrying of weapons, ammunition, explosives or explosive devices) of RA Criminal Code and against the third one – according to the Part 1 of the Article 38-104 (supporting murder) of RA Criminal Code.
Preliminary investigation of the part on illegal sale of weapon separated from the criminal case was suspended pursuant to the Point 2 of the Part 1 of the Article 31 of RA Criminal Procedural Code (the criminal proceedings may be suspended, completely or partly, upon the resolution of the prosecutor, the investigator or the court, if: accused has escaped from investigation or trial, or his whereabouts still remain unknown because of other reasons).
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
