Charge Pressed for Kidnapping, Banditry and Robbery Attempt
Preliminary investigation of the criminal case separated from the criminal case initiated on kidnapping 26 year-old resident of Vanadzor, banditry against him and robbery attempt was completed in the Department of Investigation of Crimes against Humanity of General Department of Investigation of Particularly Important Cases of the RA Investigative Committee.
In the result of investigatory actions of great volume and operative-intelligence measures, as well as operative-searching measures a number of circumstances of the case, the motive were found out.
Through preliminary investigation it was particularly found out that on September 5, 2017 the resident of Vanadzor, born in 1992, learning that his fellow citizen – 26 year-old man had 300.000 AMD which he had received from the bank as a loan, with the purpose of stealing it reached prior agreement with his friends, invited the 26 year-old man to the café and demanded that he should give him the money. After being refused together with his friends he kidnapped him by cheating and using violence and took him to the area called “Tezh Ler” of Lori province where they again used violence against him hitting him with hands and feet on different parts of his body. Then with the purpose to find the money they took him to his apartment located in Vanadzor, threatening to kill him demanded the money, took off his clothes and found the money of significant amount – 300.000 AMD in the shoe.
Through investigation data were also obtained that the same 27 year-old man learning that the affected was going to receive a loan again, with prior agreement with a group of people on September 6, 2017 at about 17:00 followed him and waited for him to come out of the bank.
After 26 year-old man had come out of the bank just in front of the bank he tried to take his bag threatening with a knife. However, 26 year-old man could protect himself with a small axe he was keeping with him for self protection. Those having attacked him escaped without completing the crime under unforeseen circumstances.
On the base of the obtained sufficient evidence charge was pressed against the man, born in 1992, according to the Points 1 and 7 of the Part 2 of the Article 131, the Point 1 of the Part 2 of the Article 175 as well as the Points 1 and 4 of the Part 2 of the Article 34-176 of RA Criminal Code.
Considering that data obtained through preliminary investigation are sufficient to send the criminal case to court, the part on the 27 year-old man was separated as a separate proceeding and preliminary investigation was completed. The criminal case with the bill of indictment was sent to prosecutor supervising the legality of preliminary investigation.
Let us mention that within the mentioned criminal case charge was earlier pressed against 5 more persons according to the Points 1, 7 of the Part 2 of the Article 131 and the Points 1 of the Part 2 of the Article 175, and against one person – according to the Part 2 of the Article 340 of RA Criminal Code. The parts on them were separated from the criminal case, preliminary investigation was completed and the criminal cases with the bill of indictment were sent to court.
Preliminary investigation is ongoing. Measures are taken to provide the comprehensive, complete and objective investigation of the case, to find others involved in the incident and give appropriate criminal legal assessment to their actions.
Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
