Smuggling of Narcotic Drug in Particularly Large Amount and False Crime Reporting against Employees of National Security Service

RA citizen reaching prior agreement with his friend left for the Islamic Republic of Iran where he illegally procured from his acquaintance – IRI citizen narcotic drugs of opium type in particularly large amount - 98.37 grams and hid it in his body to take it to the Republic of Armenia.

While crossing the RA state border the employees of the National Security Service subjected him to double customs clearance through X-rays to check the operative information received. As a result, cylindrical item was found in his body (large intestine) after which the latter confessed that there was narcotic drug in the item found inside him and asked to remove it from his body by medical intervention.

For this purpose he was taken to medical center where the citizen without medical intervention removed the narcotic drug himself, presented to the law enforcement bodies and a protocol was made in this relation.

Within the criminal case initiated in the Investigative Department of the RA National Security Service according to the Point 1 of the Part 4 of the Article 267.1 (drug smuggling) and the Point 2 of the Part 3 of the Article 38-266 (illegal turnover of narcotic drugs or psychotropic materials with the purpose of sale) of RA Criminal Code charge was pressed against the mentioned citizen and the criminal case with the bill of indictment was sent to court.

However, during preliminary investigation the mentioned person declared that there had not been any drug inside him, the drug found had nothing to do with him and the personal search had been conducted without witnesses.

In the result of investigatory and other procedural actions conducted within the criminal case initiated on the base of his report according to the Part 1 of the Article 333 (false crime reporting) of RA Criminal Code in General Department of Investigation of Particularly Important Cases of the RA Investigative Committee it was found out that the information submitted by the latter did not correspond to reality and the actions carried out by the employees of law enforcement body were legal.

Charge was pressed against the mentioned person according to the Part 1 of the Article 333 (false crime reporting) of RA Criminal Code. Detention was chosen as a pretrial measure against him.

Preliminary investigation was completed and the criminal case with the bill of indictment was sent to court.

Note; Everyone charged with alleged crime offence shall be presumed innocent until proved guilty according to law.
